This law came into force on August 16, 2020 and is adopted and enforced by the national data protection authority, Autoridade Nacional de Proteção de Dados (ANPD).
What is the Lei Geral de Proteção de Dados Pessoais (LGPD)?
The Lei Geral de Proteção de Dados (LGPD) is a comprehensive data protection law in Brazil that regulates the collection and use of personal data. The LGPD was heavily influenced by the European Union's General Data Protection Regulation (GDPR) and is similar to it in many respects. With a total of 65 articles, the LGPD protects the rights of data subjects whose data is collected and processed.
Who does the LGPD apply to?
According to Article 3 of the LGPD, your company is obliged to comply with this law if it meets the following criteria:
Companies based in Brazil
Any company based in Brazil that processes personal data must comply with the LGPD.
International companies
Companies that are not based in Brazil but process personal data of individuals in Brazil must also comply with the LGPD.
Public institutions
Brazilian state and municipal authorities and other public institutions that process personal data must also comply with the provisions of the LGPD.
